Terms of Use

These Terms of Use ('Terms') are a custom end-user license agreement between you and Circle Up Stories LLC, a New Jersey limited liability company ('Circle Up Stories,' 'we,' 'us,' or 'our'). Circle Up Stories LLC is the legal entity that offers the Build, Piggy, Build! website at buildpiggybuild.com and the Build, Piggy, Build! mobile application (together, the 'Services'). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Privacy practices are described in our Privacy Policy, which is part of these Terms.

The game

Build, Piggy, Build! is a family card game. The website describes the game and may sell the physical edition. The app lets you play a digital table game on your device against built-in computer opponents. Bot play does not require an account or an internet connection.

Live vs. mode, friends, join links, and public leaderboards require a signed-in account and a network connection. The Piggy Wall (bricks, badges, and play stats) is stored on your device. If you sign in, that wall can sync to your account so it follows you across devices.

Who may use the Services

You may use the Services if you can form a binding contract with Circle Up Stories LLC. If you are under the age required in your location to form a contract, a parent or guardian must review these Terms and permit your use. Parents and guardians are responsible for a child's use of the app.

Online accounts, vs. mode, friends, join links, and leaderboards are limited to users 13 and older (or the digital consent age where you live). By creating an account you confirm you meet that age.

Accounts, usernames, and vs. mode

On iOS you sign in with Apple. Where offered, you may also sign in with Google. You must pick a username. We may reject names that use profanity, impersonate staff, or are otherwise not allowed. Your username, win stats, and Piggy Wall progress may appear on public leaderboards or on your wall. Do not share join links with people you do not want at your table.

You are responsible for play at tables you host or join. There is no in-app chat. We may suspend or delete an online account if you cheat, harass others, abuse join links, or otherwise break these Terms. Deleting the app does not by itself delete your online account; use Delete account in Settings or email us.

Apple's and, where used, Google's terms also apply to their sign-in services.

License

Circle Up Stories LLC grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the website and, if you have obtained the app from an authorized store, to install and play the app on devices you own or control, for personal, non-commercial entertainment.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Services, except as the law allows
  • Reverse engineer the app except to the extent applicable law prohibits that restriction
  • Use the Services for any commercial purpose without our written permission
  • Circumvent security or access the Services in a way we did not intend
  • Use our names, logos, characters, or card art except as needed for normal personal use of the app or as allowed by law (for example, fair use)

Buying the physical game

The website may offer the physical Build, Piggy, Build! card game for sale. Prices are shown on the site before you pay. Checkout is processed by Square, not on our servers. Square may charge tax and shipping according to the address you enter.

We ship within the United States. Delivery times depend on the carrier. Title and risk of loss pass to you when we hand the package to the carrier.

If your game arrives damaged or incomplete, email privacy@buildpiggybuild.com with a photo and we will replace it or refund the purchase. We do not otherwise accept returns of opened games.

A parent or guardian must complete any purchase. Do not enter a child's name, email, or address as the buyer.

Intellectual property

The Services, including the game, rules, characters, card art, logos, video, and website design, are owned by Circle Up Stories LLC or its licensors and are protected by copyright and other laws.

These Terms do not transfer any ownership to you. All rights not expressly granted are reserved by Circle Up Stories LLC.

App stores

If you download the app from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple's terms control if they conflict with these Terms on a point Apple requires. These Terms are the custom EULA offered by Circle Up Stories LLC. Apple is not a party to that custom EULA and is not responsible for the app or its content. You acknowledge that Apple has no obligation to furnish maintenance or support. In the event of a failure of the app to conform to an applicable warranty that Apple cannot disclaim, Apple may refund the app purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms as they relate to your use of the iOS app, and may enforce them against you.

No professional advice

The Services are entertainment. They are not a substitute for the physical tabletop game's packaging, safety labeling, or any applicable children's product documentation.

Disclaimers

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' TO THE FULLEST EXTENT PERMITTED BY LAW, CIRCLE UP STORIES LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or future operating system version.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CIRCLE UP STORIES LLC AND ITS OWNERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR TEN U.S. DOLLARS ($10), WHICHEVER IS GREATER.

Some places do not allow certain limitations. In those places, the above limits apply only as far as the law allows. Nothing in these Terms limits rights you have as a consumer that cannot be waived.

Changes and availability

We may update the website, the app, or these Terms. The date at the top of this page will change when we do. We may also stop offering the website or app. If you continue to use the Services after Terms change, you accept the new Terms.

Termination

You may stop using the Services at any time by closing the website or deleting the app, and you may delete an online account in Settings. We may suspend or stop providing the Services, including online play, if you breach these Terms or if we discontinue the product.

Governing law

These Terms are governed by the laws of the United States and the State of New Jersey, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, the state or federal courts located in New Jersey will have exclusive jurisdiction, except that you may have additional rights in your place of residence that cannot be waived.
